Terms of Service

1. Eligibility and your account

You must provide accurate information when creating an account and keep your sign-in credentials secure.

You are responsible for activity that occurs through your account.

If you are under the age of majority where you live, you may use Cartavia only with the permission of a parent or legal guardian.

You may delete your account through Settings → Delete my account. Account deletion is subject to any information we may be legally required to retain, as described in our Privacy Policy.

2. What Cartavia provides

Cartavia helps users organize and plan home cooking through features that may include:

• personalized meal planning;
• recipe saving and importing;
• recipe recommendations;
• grocery-list creation;
• estimated grocery pricing;
• budget-based meal-plan adjustments;
• Kitchen Memory and ingredient tracking;
• receipt and cookbook-page scanning;
• nutrition estimates;
• serving adjustments;
• equipment-aware recommendations;
• ingredient substitutions;
• store and product information; and
• other related features that we may add or change over time.

Cartavia is a planning and informational tool. We do not guarantee that every recommendation, recipe, price, product, nutrition value, ingredient match, quantity, image, or other result will be complete or error-free.

3. Food, allergies, diets, and health information

Cartavia may use the diets, allergies, dislikes, preferences, and other information you provide to personalize recipes and recommendations.

However, recipes, imported content, ingredient lists, product information, substitutions, nutrition information, and automated results may contain errors or may become outdated.

Always review ingredients, product labels, allergen statements, preparation instructions, and food-safety information yourself before preparing or consuming food.

Do not rely on Cartavia as your only source of information when managing a food allergy, dietary restriction, medical condition, or other health concern.

Cartavia does not provide medical, nutritional, dietary, or other professional health advice. Information provided through the Service is for general informational and planning purposes only.

If you have a serious allergy, medical condition, or dietary concern, consult an appropriate qualified professional.

4. Food safety and freshness estimates

Cartavia may estimate when foods should be used or may identify items as needing to be used soon.

These estimates are based on available information and do not determine whether food is safe to eat.

Storage conditions, packaging, handling, preparation, temperature, product condition, and other factors can affect food safety and freshness.

Always inspect food yourself, follow package instructions and applicable food-safety guidance, and discard food if you believe it may be unsafe.

5. Grocery prices, budgets, products, and availability

Grocery prices, package sizes, store availability, estimated savings, meal costs, and budget calculations displayed by Cartavia are estimates unless expressly stated otherwise.

Actual prices, promotions, taxes, fees, package sizes, brands, substitutions, availability, and inventory may vary by retailer, store, location, and time.

Cartavia does not guarantee that:

• a product will be available at a particular store;
• a displayed price will match the price charged by a retailer;
• a grocery list will remain within your selected budget;
• a recommended package size will exactly match what a retailer sells; or
• a store comparison will reflect every available retailer or promotion.

Always confirm prices, quantities, and product details before making a purchase.

6. Nutrition information

Calories, protein, carbohydrates, fat, serving sizes, and other nutrition information shown in Cartavia may be calculated or estimated using third-party data, recipe information, automated systems, or other sources.

Nutrition information may not reflect a specific brand, preparation method, serving size, substitution, or product you ultimately use.

You should not rely on Cartavia's nutrition information for medical treatment or as a substitute for professional dietary or medical advice.

7. Automated and AI-assisted features

Cartavia may use artificial intelligence, machine learning, automated extraction, and other automated technologies to provide features such as:

• recipe generation;
• recipe imports;
• ingredient extraction;
• cookbook and receipt scanning;
• meal recommendations;
• substitutions;
• nutrition estimates;
• product matching;
• images or descriptions; and
• other personalized results.

Automated results can be incomplete, inaccurate, or inappropriate for your circumstances.

You are responsible for reviewing outputs before relying on them, cooking from them, or making purchasing decisions based on them.

8. Recipe imports and third-party content

Cartavia may allow you to import or save recipes and other content from websites, social platforms, cookbook pages, photos, or other sources.

You are responsible for ensuring that you have the right to upload, import, copy, store, or use content you submit to Cartavia.

Cartavia does not grant you ownership of third-party recipes, images, videos, trademarks, or other intellectual property.

Links, names, trademarks, recipes, products, and content belonging to third parties remain subject to the rights of their respective owners.

Third-party websites, services, retailers, and platforms are not controlled by Cartavia, and their own terms and privacy practices may apply.

9. Your content

You retain ownership of original content that you submit to Cartavia, such as your own recipes, photos, notes, ratings, and other materials ("User Content").

By submitting User Content, you grant Cartavia a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, modify, and display that content as reasonably necessary to operate, maintain, personalize, improve, and provide the Service to you.

If Cartavia later offers public or community-sharing features, additional controls or terms may apply before your content is made public.

You represent that you have the necessary rights to submit your User Content and that your User Content does not violate applicable law or the rights of another person.

10. Ratings, feedback, and reports

If you submit ratings, reviews, feedback, suggestions, bug reports, or other comments about Cartavia, you authorize us to use that information to operate, evaluate, improve, and develop the Service.

We may use aggregated or de-identified feedback and usage information to improve recommendations and features.

Submitting feedback does not give you ownership rights in any resulting improvements, features, or products developed by Cartavia.

11. Premium subscriptions and purchases

Some Cartavia features may require a paid subscription or other purchase.

Prices, subscription lengths, included features, and applicable purchase terms will be disclosed before you complete a purchase.

For purchases made through Apple's App Store, billing, renewal, cancellation, refunds, and payment processing are handled through your Apple account and are subject to Apple's applicable terms and policies.

For purchases made through Google Play, billing, renewal, cancellation, refunds, and payment processing are handled through your Google account and are subject to Google Play's applicable terms and policies.

For purchases made through another platform or payment provider, that provider's applicable terms may also apply.

Unless otherwise disclosed, subscriptions may automatically renew until canceled through the platform where you purchased them.

Deleting your Cartavia account does not necessarily cancel an active subscription. You are responsible for canceling subscriptions through the applicable App Store or payment provider.

12. Acceptable use

You may use Cartavia only for lawful personal purposes and in accordance with these Terms.

You may not:

• attempt to gain unauthorized access to Cartavia or another user's account;
• interfere with or disrupt the Service;
• bypass security, access, rate, or usage restrictions;
• scrape, crawl, harvest, or systematically extract data from the Service without our written permission;
• reverse engineer, decompile, disassemble, or attempt to derive source code except where applicable law expressly permits it;
• copy, resell, sublicense, distribute, or commercially exploit Cartavia or its content without permission;
• upload unlawful, infringing, fraudulent, harmful, or malicious material;
• use Cartavia to violate the rights of another person;
• impersonate another person or misrepresent your affiliation with another person or organization; or
• use automated systems to abuse or overload the Service.

We may suspend or terminate access when we reasonably believe these Terms have been violated or when necessary to protect Cartavia, our users, or others.

13. Cartavia intellectual property

Cartavia, including its software, design, branding, logos, interfaces, text, graphics, features, and other materials created by or for Cartavia, is owned by Cartavia LLC or its licensors and is protected by applicable intellectual-property laws.

Except for the limited rights necessary to use the Service, these Terms do not grant you ownership of Cartavia or its intellectual property.

"Cartavia" and related branding may not be used without our permission except as permitted by law.

14. Third-party services

Cartavia may rely on or integrate with third-party services, including hosting providers, analytics providers, artificial-intelligence providers, mapping or location providers, product and grocery-data providers, retailers, payment processors, and app-store platforms.

We are not responsible for the availability, accuracy, security, content, or performance of third-party services that we do not control.

Your use of third-party services may also be subject to their own terms and privacy policies.

15. Changes to the Service

We may add, change, suspend, limit, or discontinue features or portions of Cartavia at any time.

Features available during beta, testing, preview, or early-access periods may change significantly or may be removed.

We do not guarantee that any particular feature will always remain available.

16. Beta and pre-release features

Cartavia may offer beta, TestFlight, early-access, experimental, or pre-release versions of the Service.

These versions may contain bugs, incomplete features, interruptions, inaccurate results, or other issues.

By using a beta or pre-release version, you understand that the Service is still being tested and may change without notice.

17. Account suspension and termination

You may stop using Cartavia at any time.

We may suspend or terminate your account or access to the Service if you materially violate these Terms, misuse the Service, create security or legal risk, or if suspension is reasonably necessary to protect Cartavia or others.

Where appropriate, we may provide notice before termination.

Provisions of these Terms that by their nature should survive termination will continue to apply after your account ends.

18. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARTAVIA AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE."

CARTAVIA LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, NON-INFRINGEMENT, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY RECIPE, PRICE, PRODUCT, NUTRITION INFORMATION, INGREDIENT MATCH, RECOMMENDATION, OR OTHER RESULT WILL BE ACCURATE OR COMPLETE.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

19. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARTAVIA LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST SAVINGS, BUSINESS INTERRUPTION, OR SIMILAR LOSSES ARISING FROM OR RELATED TO YOUR USE OF CARTAVIA.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARTAVIA LLC'S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID DIRECTLY TO CARTAVIA FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
• $100 USD.

Nothing in these Terms limits liability where applicable law does not permit such a limitation.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Cartavia LLC and its members, officers, employees, contractors, and affiliates from claims, damages, losses, liabilities, and reasonable expenses arising from:

• your unlawful misuse of the Service;
• your violation of these Terms;
• your User Content; or
• your violation of another person's rights.

This section does not apply to the extent prohibited by applicable law.

21. Governing law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

Any dispute that is not required by applicable law to be heard elsewhere will be brought in a court of competent jurisdiction located in Illinois.

Nothing in these Terms prevents a consumer from exercising rights provided by applicable law.

22. Changes to these Terms

We may update these Terms from time to time.

When we make changes, we will update the "Last updated" date at the top of this page.

If we make material changes, we may also provide additional notice through Cartavia, by email, or by another reasonable method.

Your continued use of Cartavia after updated Terms become effective means you accept the updated Terms, to the extent permitted by law.

23. Apple App Store terms

If you access Cartavia through Apple's App Store, you acknowledge and agree that:

• these Terms are between you and Cartavia LLC, not Apple;
• Cartavia LLC, not Apple, is responsible for Cartavia and its content;
• your license to use the Cartavia application is non-transferable and limited to Apple-branded products that you own or control, subject to Apple's applicable Usage Rules;
• Apple has no obligation to provide maintenance or support services for Cartavia;
• Apple is not responsible for addressing claims relating to Cartavia, including product-liability, regulatory, consumer-protection, or intellectual-property claims, except as required by applicable law;
• you must comply with applicable third-party terms when using Cartavia;
• you represent that you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as supporting terrorism, and that you are not listed on a U.S. Government prohibited or restricted-party list; and
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable App Store provisions against you.
